In 2010 the Commonwealth of Massachusetts implemented 201 CMR 17.00 “Standards for the Protection of Personal Information of Residents of the Commonwealth” which establishes minimum standards for the safeguarding of personal information and requiring companies to disclose data breaches.  Each business is responsible for reviewing and updating their written information security policy (WISP) each year.

Penalties of $5,000 or more can be assessed for failure to maintain a WISP or delaying/failure to notify state authorities of security breaches.  Personal information includes not only customer credit card information but also W-2s, 1099s, applications for employment, insurance enrollment forms, retirement enrollment forms, etc.  Almost all businesses handle sensitive, confidential data and it is important to understand how to protect it
